In an unprecedented move, a Nigerian court delivered a judgement against a duly registered Nigerian Organisation. The case which was between The Chartered Institute of Arbitrators v. The Chartered Institute of Arbitrators (Nigeria) LTD/GTE was heard at the Federal High Court, Lagos Judicial Division. The plaintiff in the matter sued the defendant on grounds of “passing off.”
The defendant which is The Chartered Institute of Arbitrators (Nigeria) LTD/GTE is a duly registered Nigerian organisation incorporated in 1988, whilst the plaintiff a foreign organisation registered only in the United Kingdom, carries on business with all its attached benefits in Nigeria.
Strangely a foreign organisation not registered in Nigeria brings a claim of passing off against a duly registered Nigerian organisation and gets a judgement in its favour, leaves much to be desired and speaks volume about the state of affairs in the country. Whilst some may not have a good understanding of the issues here, for so many Nigerians, this matter borders on the issue of the rights of Nigerians and Nigerian entities to have full recognition or say in the affairs of their country.
